Wearable technology is one of the newest market trends that can be seen in the popularity of products such as Google glass. Many companies in Michigan and elsewhere have become profitable by offering wearable technology products to consumers. However, there are still some risks associated with this particular sector. One of these is the possibility of business litigation resulting from defective products.
One company is currently facing this problem after its product was found to be defective. It has even allegedly caused consumers to require medical attention. Fitbit is the maker of a digital bracelet known as the Force. The product is designed to track sleep patterns and physical activity. Problems for the company began to arise when consumers complained of experiencing skin irritations of varying seriousness.
Despite announcing a recall of the product as well as offering refunds to customers, there were some people who were still upset about the issues they endured. The company has announced the results of its investigation into the matter, which states that "allergic contact dermatitis" is believed to be the cause of the skin irritations that had been reported for 1.7 percent of consumers who purchased the product. However, the plaintiffs of a recent lawsuit do not believe the company has done enough, and it is now pursuing a class-action lawsuit to force the company to reveal more information regarding the cause of the skin irritations.
On the other hand, just like any other business litigation lawsuit in Michigan or any other state, the company has the right to present its own side of the story. The company notes that it had acted to remedy the issue long before the time of the complaint's filing. However, in order to prevail in defending the lawsuit, the company will need to have an understanding of applicable law as well as the correct litigation procedures.
